1. Acceptance of Terms

Welcome to BS Films! These Terms of Service ("Terms") govern your access to and use of the BS Films mobile application and streaming service ("Service"), operated by Bus Stop Films, registered in the Netherlands.

By creating an account, accessing, or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Service.

2. Eligibility

You must be at least 13 years of age to use BS Films. By using our Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are under 18, you must have parental or guardian consent to use the Service.

3. Account Registration and Security

To access BS Films, you must create an account using a valid email address. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the confidentiality of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activities that occur under your account

4. Subscription and Billing

Subscription Plans

BS Films offers monthly and yearly subscription plans. Pricing is displayed in the app and may vary by region.

Free Trial

New users are eligible for a 3-day free trial. After the trial period ends, your subscription will automatically begin, and you will be charged the applicable subscription fee unless you cancel before the trial expires.

Billing

Subscription fees are billed in advance on a recurring basis (monthly or yearly, depending on your plan). You authorize us to charge your selected payment method at the start of each billing cycle.

Auto-Renewal

Your subscription automatically renews at the end of each billing period unless you cancel. You will be charged the then-current subscription rate. You can manage your subscription and turn off auto-renewal in your account settings or through your device's app store.

Cancellation

You may cancel your subscription at any time through your account settings or your device's app store. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until the end of the paid period.

No Refunds

All subscription fees are non-refundable. We do not provide refunds or credits for partial subscription periods, unused content, or if you cancel your subscription before the end of a billing cycle.

Price Changes

We may change subscription prices at any time. Price changes will apply to your next billing cycle after we provide you with at least 30 days' advance notice. Continued use of the Service after a price change constitutes acceptance of the new price.

5. Device and Account Limits

  • Your account may be used on up to 3 devices simultaneously.
  • Account sharing is strictly prohibited. Your account is for personal use only and may not be shared with others outside your household.
  • There is no limit on the number of simultaneous streams per account, provided you stay within the 3-device limit.
  • Violation of these limits, including sharing your account with multiple unauthorized users or devices, may result in immediate account suspension or termination without warning.

6. Content and License

BS Films grants you a limited, non-exclusive, non-transferable, revocable license to access and stream short films available on our Service for your personal, non-commercial use, subject to these Terms. This license includes:

  • Streaming films on supported devices for personal viewing
  • Downloading films for offline viewing within the app (downloaded content never expires but requires an active subscription)
  • You may not copy, reproduce, distribute, publicly display, publicly perform, or create derivative works from any content on our Service
  • You may not use any content for commercial purposes
  • This license terminates automatically upon termination of your account or subscription

7. Geographic Availability

BS Films is initially available exclusively in the Netherlands. We plan to expand to other countries in the future. Some content may be subject to geographic restrictions due to licensing agreements. You may not use VPNs or other methods to bypass geographic restrictions.

8. User Conduct and Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Violate any applicable laws, regulations, or third-party rights
  • Infringe upon intellectual property rights, privacy rights, or other proprietary rights
  • Record, reproduce, redistribute, or publicly display any content from the Service
  • Circumvent, disable, or interfere with security features or digital rights management (DRM) systems
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use bots, scrapers, or automated tools to access the Service
  • Manipulate view counts, ratings, or engagement metrics
  • Upload viruses, malware, or any malicious code
  • Impersonate any person or entity, or falsely represent your affiliation
  • Interfere with or disrupt the Service or servers/networks connected to the Service

9. User Ratings and Feedback

Users may rate films on BS Films. Ratings are used to improve recommendations and help other users discover content.

You may submit feedback about the Service. Feedback is visible only to BS Films developers and is used to improve the app and user experience.

By submitting ratings or feedback, you grant BS Films a worldwide, perpetual, royalty-free license to use, reproduce, and display your contributions to improve and promote the Service.

10. Intellectual Property Rights

All films available on BS Films remain the exclusive property of their respective filmmakers and creators. Filmmakers retain all rights, title, and interest in their content. BS Films holds only streaming rights as granted by filmmakers through separate licensing agreements.

The BS Films platform, including the app design, user interface, features, logos, trademarks, and all related intellectual property, are owned by Bus Stop Films and are protected by copyright, trademark, and other intellectual property laws.

11. Service Modifications and Improvements

We reserve the right to improve, modify, or add features to the Service at any time without prior notice. These changes may include new functionalities, updated user interfaces, or enhanced content recommendations.

For significant changes that materially affect your rights or access to the Service, we will provide reasonable advance notice.

We may, at our discretion, discontinue the Service or any part thereof at any time with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

12. Service Availability and Performance

BS Films relies on third-party infrastructure providers, including Cloudflare CDN and Supabase, for content delivery and data storage. While we strive to provide reliable service, we do not guarantee uninterrupted, timely, secure, or error-free access to the Service. Service availability may be affected by factors beyond our control, including internet connectivity, server maintenance, and third-party service disruptions.

13. Termination and Suspension

Termination by You

You may terminate your account at any time by canceling your subscription through your account settings or contacting support. Upon cancellation, you will retain access until the end of your current billing period.

Termination by BS Films

We reserve the right to suspend or terminate your account immediately, without warning or refund, if we detect:

  • Violation of these Terms of Service
  • Fraudulent activity, including payment fraud or unauthorized account access
  • View count manipulation, fake engagement, or rating manipulation
  • Unauthorized account sharing or exceeding device limits
  • Payment failure or chargebacks

Account termination for fraud or abuse is immediate and final. We do not provide warnings, and there is no appeal process.

Effect of Termination

Upon termination, your right to access the Service immediately ceases. All downloaded content will become inaccessible. We may delete your account data in accordance with our Privacy Policy.

14. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, BS Films disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BS FILMS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

16. Indemnification

You agree to indemnify, defend, and hold harmless BS Films, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any fraudulent, unlawful, or prohibited activity.

17. Governing Law

These Terms and your use of the Service are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the courts of the Netherlands.

18. Dispute Resolution

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at support@bsfilms.com. We will work in good faith to resolve the matter within 30 days.

If informal resolution is unsuccessful, either party may initiate formal legal proceedings in the courts of the Netherlands as specified in the Governing Law section.

19. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app and updating the "Last Updated" date. For significant changes, we may provide additional notice via email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

20. Miscellaneous

  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect
  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and BS Films regarding the Service
  • Waiver: No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction
